Andante Conditions of Use

The present Conditions of Use are an integral part of the Andante Contract and have the purpose of regulating the use of the Andante transport tickets in the intermodal public transport system of Porto Metropolitan Area which is governed by the articles below and by the applicable legal provisions.

For the purposes of this contract, the following definitions shall apply:

  1. Transport ticket: computer record (occasional or pass type) entitling the holder to one or more trips after proper validation;
  2. Andante Card: exclusive model material, paper or PVC, rechargeable with Andante transport tickets; Journey: trip, with one or more stops, supported by a valid transport ticket;
  3. Validator: equipment that allows validating the transport ticket;
  4. Validation of transport ticket: to approach the Andante card loaded with a valid ticket or the running Anda App to the validator;
  5. Anda App: mobile phone application that allows its user to travel on the operators that adhere to the Andante Intermodal System, assigning at each moment the transport tickets that allow benefiting from the most advantageous price for the number and type of trips made in each calendar month. The use of the App is under the Anda Terms and Conditions of Use published and accepted by the customer, whose acceptance is necessary to complete the registration of the App and to enable its use;
  6. Zoning: division of Porto Metropolitan Area into fare zones;
  7. TIP – Transportes Intermodais do Porto, A.C.E., Agrupamento Complementar de Empresas, with the single registration and taxpayer number 506240266, registered at the Companies Register of Porto, with a share capital of 30,000.00 € responsible for managing the Andante intermodal ticketing system, hereinafter referred to as TIP;
  8. Adhering operators: set of public transport operators that have joined the intermodal system promoted by TIP.
  1. The Andante cards have an internal electronic circuit, so they should be stored carefully, namely without bending, scratching, tearing or getting them wet.
  2. The customer must purchase the Andante card whose price is independent of the amount to pay for the transport ticket.
  3. The Andante blue (paper) card is not personalised, but can only be used once per person on each journey.
  4. The validity of the Andante blue card is 1 year. Once this deadline has passed, the cards can no longer be recharged although the use of the remaining transport tickets is permitted for the following 12 months.
  5. The Andante PVC card is personalised and can only be used by its holder.
  6. The validity period for Andante PVC card is 5 years Once this deadline has passed, the cards can no longer be recharged although the use of the remaining transport tickets is permitted for the following 12 months.
  7. TIP ensures transfer of the remaining transport tickets to a new card, as long as the card is within its validity period or within the next 12 months.
  8. In the situation referred to in the previous point, the cost of the new card is on the customer.
  9. TIP guarantees the replacement of a broken Andante card, as long as it is in good physical condition and is covered by the guarantee period, as stipulated in Decree-Law no. 67/2003, of 8 April, as amended in the meantime.
  10. TIP does not accept card returns.
  1. The Andante transport tickets are exclusively loaded on Andante cards with the exception of the one referred in the following point.
  2. Users of the Anda App are also entitled to use the Andante Intermodal System, and this application provides the transport tickets that allow them to benefit from the most advantageous price for the number and type of trips made in each calendar month.
  3. There are two types of Andante transport tickets:
    1. Occasional tickets: valid in a set of rings of zones that are counted around the zone where the customer started their journey (place of the 1st validation) and up to the limit of rings acquired, during a certain period of time.
    2. B) Pass tickets: valid for a set of adjacent zones previously chosen by the customer during a calendar month.
  4. The minimum charge for each transport ticket is two zones.
  5. There may be tickets with specific features of their own, so customers should get informed of their features when purchasing them.
  1. The transport tickets referred to in the following articles are subject to a discount in relation to the Andante normal monthly pass fare.
  2. Discounts apply to the normal pass price and are not cumulative with any other discounted fare.
  3. The pass tickets with discount and the respective attribution conditions are the ones approved by the competent entities, and are listed in specific information, available to the public throughout the entire Andante sales network and Andante website.
  4. Access to discount pass tickets is subject, in addition to the other provisions set forth in this contract, to the delivery of documentation proving legitimacy for their attribution and use. The list of required documents is available to the public throughout the entire Andante sales network and Andante website.
  5. The data mentioned in the preceding paragraph shall be collected and recorded with due observance of the measures necessary to protect the confidentiality of the information received, and access shall be restricted to the entity responsible for its processing, under the terms of the law.
  6. TIP reserves the right to call on official entities for confirmation of the information provided.
  7. Monthly pass may not be available for sale in all sales network channels.
  8. It is mandatory to renew discounted fares annually by submitting new documentation, with the exception of seniors’ fares, which are renewed every 5 years.
  1. Andante monthly pass for all students from 4 to 18 years old (inclusive) who do not attend higher education and who do not benefit from school transport assured by the City Councils.
  2. The transport ticket referred to in article 1 is subject to a discount in relation to Andante normal monthly pass fare.
  3. The beneficiaries of Level A of the School Social Action benefit from special conditions when subscribing to the mentioned transport ticket (4_18 A).
  1. Andante monthly pass for all students up to the age of 23 (inclusive) attending higher education in study programmes officially recognised by the Ministry responsible for Higher Education.
  2. Higher education students enrolled in Medicine and Architecture study programmes benefit from this transport ticket until the age of 24 (inclusive).
  3. The transport ticket referred to in article 1 is subject to a discount in relation to Andante normal monthly pass fare.
  4. The beneficiaries of Direct Social Action in Higher Education benefit from special conditions when subscribing to the mentioned transport ticket (Sub23 A).
  1. Andante monthly pass aimed at individuals and households with lower economic resources, namely:
    1. A) Retirees and pensioners whose total monthly value of pensions, pension supplements and other gross household income is less than or equal to 1.2 times the value of the IAS – Social Support Index.
    2. B) All members of households with an average monthly equivalent income lower than or equal to 1.2 times the value of the IAS.
    3. Beneficiaries of unemployment benefit and unemployment social benefit with a monthly income lower than or equal to 1.2 times the value of the IAS.
    4. D) Beneficiaries of the Social Integration Income (RSI).
    5. E) Beneficiaries of the Senior Citizens Solidarity Supplement (CSI).
  2. The transport ticket referred to in article 1 is subject to a discount in relation to Andante normal monthly pass fare.
  3. The beneficiaries of the Social Integration Income (RSI) or the Solidarity Supplement for the Elderly (CSI) benefit from special conditions when subscribing to the mentioned transport ticket (Social A).
  1. Andante monthly Pass for people aged 65 and over.
  2. The transport ticket referred to in article 1 is subject to a discount in relation to Andante normal monthly pass fare.
  1. Andante monthly pass aimed at households (minimum 3 elements) with tax residence in one of the 17 municipalities of Porto Metropolitan Area.
  2. Andante Family is a monthly pass attributed to each member of the household that allows the total payment of the value equivalent to 2 Andante 3Z / Municipal pass or the value equivalent to 2 Andante Metropolitan pass.
  1. Andante monthly pass for all children aged 4 to 12 years old (inclusive) living in Porto Metropolitan Area, which allows free use of public transport included in the Andante intermodal system throughout Porto Metropolitan Area.
  2. The transport ticket referred to in paragraph 1 shall be completely free of charge.
  3. The Andante Sub13 monthly ticket is annual, that is, topped up once on the child’s birthday month and is valid for 12 months.
  4. The card is valid until the month in which the child turns 13 or until the date stated on the card itself.
  5. The cost of the Andante card is on the customer.

The fare of Andante transport tickets is the one approved by the competent authorities and which is available to the public.

  1. Access to passenger transport is subject to prior acceptance and compliance with the provisions of the Andante Contract, the Terms and Conditions of the Anda Application, the Andante Conditions of Use and other applicable legal provisions in force.
  2. All passengers are obliged to have a duly loaded Andante card with Andante transport tickets or be a user of the Anda App;
  3. Children under 4 years of age are exempt from the obligation referred to in the previous number as long as they do not occupy a seat.
  4. Customers must validate their transport tickets on every boarding they make during their journey, with a maximum advance warning of 10 minutes, and keep them during the whole period of use.
  5. Customers must confirm the correct validation of their transport tickets.
  6. For the purposes of the previous number, validation is considered correct when, upon approaching the card or the mobile phone less than 10 cm away from the validator, the latter emits an acceptance message via a green light accompanied by a sound signal and written information of compliance on the electronic display.
  1. Andante cards use contactless technology, so, when validating the card, the customer must be careful to approach to the validator the card they intend to use. Otherwise, there is a risk that the validator will trigger the validation and respective consumption of transport tickets for any other card, or for the one it recognises first and that may not be exactly the one the customer wanted to validate. There may also be a situation where no validation takes place and the customer incurs in the payment of a fine.
  2. When loading tickets into Automatic Vending Machines (MVA), the customer must correctly select the ticket and the number of zones required. It is the customer’s responsibility to confirm that the requested operation has been completed in the desired terms before the Andante card is withdrawn from the MVA.
  1. TIP collects and processes customers’ personal data in the context of the conclusion and execution of the Andante Contract and the present Andante Conditions of Use, hence being responsible for the processing of such data.
  2. Personal customer data is processed by TIP in accordance with the provisions of applicable personal data protection legislation, including Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (‘General Data Protection Regulation’ or ‘GDPR’).
  3. TIP will process the following personal data categories:
    1. Identification data (such as name, date of birth, type and number of identification document, tax number);
    2. Contact details (such as address, e-mail, telephone/mobile phone);
    3. Data related to the transaction (such as the point of sale, date and time of the transaction, ticket type and sale price);
    4. Data related to the use of the transport ticket (such as validation effect place, date, time, hour, minute, transport operator, card number and type of ticket used);
    5. Data related to social support contained in the documentation identified in the document named ‘Tarifário Social Andante – Documentação’ (Andante Social Fare – Documentation) available for consultation in the Sales Network and on the website www.linhandante.com.
  4. TIP handles customers’ personal data on the following grounds:
    1. On the grounds that the processing is necessary for concluding and performing the transport service contract or to comply with requests made by the customer;
    2. On the grounds that the processing is necessary for fulfilling TIP’s legitimate interest;
    3. On the grounds that the processing is necessary for complying with a legal obligation to which TIP is bound;
    4. On the grounds of their free, specific, informed and explicit consent, which will occur, namely, for conducting studies as part of mobility and/or use of public passenger transport.
  5. The processing activities carried out by TIP include collecting, recording, integrating into databases, organising, storing, consulting, conveying, interconnecting and deleting personal data.
  6. Personal customer data will only be processed by TIP to the extent and for the period strictly necessary to fulfil the purposes listed above.
  7. The customer declares to be explicitly and clearly informed, without any reservation, that in order to be able to use the tickets resulting from social fares contained in the present Andante Conditions of Use, their personal data collected by TIP, as part of this contract, shall, under the terms of the applicable legislation, be shared with official entities, namely the Inspectorate General of Finance, the Tax Authority, the Mobility and Transport Authority and the Institute of Mobility and Transport.
  8. The customer also declares to be explicitly and clearly informed, without any reservation, and gives his explicit, free, specific and informed consent for TIP to, if necessary, turn to the competent bodies for confirmation of the declared data and values, in order to be able to use the tickets resulting from the social fares contained in the present Andante Terms of Use.
  9. As the controller, TIP may use third parties (‘subcontractor’) to carry out some or all of the processing of customers’ personal data under these Andante Terms of Use.
  10. Whenever using processors, TIP shall comply with all the requirements set out in the applicable data protection legislation, in particular those provided for in Article 28 of the GDPR, ensuring that such processors provide sufficient guarantees to implement appropriate technical and organisational measures to ensure the security of the data processing and the protection of data subjects’ interests and rights.
  11. The customer, as the data subject of the personal data, may at any time exercise their rights with TIP, in particular the right to be informed, to have access to their data, to rectify their data, to erase their data, to limit the processing, to have their data ported, to object to the processing of their data and not to be subject to automated individual decisions, including profiling, which produce legal effects concerning or significantly affect the customer in a similar manner.
  12. The rights referred to in the previous point should be exercised through the e-mail address [email protected] or Linhandante 226 158 151.
  13. In addition to the rights referred to in point 11 above, and in cases where the processing of personal data is based on the provision of consent by the data subject, the customer may at any time withdraw their consent, without this, however, affecting the lawfulness of the data processing carried out until that moment.
  14. The customer may also, at any time, lodge a complaint regarding TIP’s processing of their personal data with the National Data Protection Commission.
  15. TIP has appointed a Data Protection Officer, who you can contact via email at [email protected].
  16. For more information about the processing of your personal data, please consult TIP’s Privacy Policy at any time, available at www.linhandante.com.
  1. TIP has a Customer Support service always available to provide all the necessary information, receive suggestions and complaints as well as to register occurrences with the Andante ticketing equipment.
  2. The Customer Support of the Andante intermodal system is provided by: Andante Sales Network, Linhandante 226 158 151 (according to its opening hours), www.linhandante.com and [email protected].
  3. If the customer wishes to make a complaint, they must provide the following information: identification and contact of the customer, number of Andante card or email of registration in the Anda AppApp, transport operator and line used, vehicle number and precise time of occurrence of the fact, as well as the Automatic Vending Machine number, when applicable.

The inspection and issuing of notices are the sole responsibility of the transport operators adhering to the Andante Intermodal System.

The rendering of the transport service is of the exclusive competence of each operator that adheres to the Andante Intermodal System, and any fact subject to civil liability falls within its sphere.

These terms of use shall enter into force on 1 september 2020.
